THE CANNABIS STORE OPENS IN THE CENTER OF MALAGA

The cannabis store has arrived at the Center of Malaga. The Italian Cannabis Store Amsterdam franchise, specialized in the sale of products related to this plant, has just opened an establishment on Calderería street, next to Uncibay square. Specifically, it is the premises that until a few months ago the Carmen Sorolla shoe store occupied, which closed its doors at the beginning of December due to the retirement of its owner. In the new cannabis store they sell all kinds of legal products related to this flower. As the sale of marijuana is prohibited in Spain, the items offered inside this premises are made with industrial hemp or with CBD essence , a compound that offers flavor and smell but without the harmful effects of the prohibited substance. In no case do they have THC, which is the illegal constituent.

The business, therefore, offers customers products of the brand –which has a striking green logo with the figure of a marijuana leaf– such as backpacks, caps or T-shirts; and ready-to-eat products such as teas, coffee, candies or creams. The person in charge of the franchise explains that in these first days, chupa chups –which are sold in various flavors– and cookies have been very well received. "Everything we sell is completely legal," he says. In these two weeks, he assures that "the 'feedback' with customers is being very good," he adds.

Born in Rotterdam, the head of the local franchise explains that he met the owners of the company on one of his many trips to the Costa del Sol. During a visit to Marbella he passed the store and liked the concept. Since then he began to investigate until at the end of December he managed to open his store in the Center. Cannabis Store Amsterdam has more than twenty stores spread throughout Europe, from London to Montpellier. In the province they already have three businesses: Marbella, Torremolinos and the capital.

Legal business

The Cannabis Store Amsterdam business is based on the legal part of the plant. According to Alberto Berdion, managing partner of the Iberislex legal consultancy, the psychotropic component is exclusively THC (tetrahydrocannabinol), while there is no prohibition on its other component: CBD (cannabidiol). This - he adds - is what has led to the company's business model. "In these stores you play with the marketing derived from the cultural aesthetics of the 'drug' , but what you can really consume are a wide variety of CBD food products".

Despite this, the Italian company arrives in the capital at a particularly delicate moment after the Court of Justice of the European Union has prevented it from registering the logo, considering it "contrary to public order . " The court understands that these symbols can incite drug use and thus denies registration to an citizen who wanted to open a food store with that name and register it as a trademark.

In a ruling published in mid-December, the court rejected the appeal filed by the Italian Santa Conte against a resolution of the Union Intellectual Property Office . This body had denied Conte the inscription as a European trademark of a figurative sign consisting of a black background with a pattern of green marijuana leaves on which 'Cannabis Store Amsterdam' can be read in white capital letters.
