How old do I have to be to travel without my car seat?

You must use an approved car seat, booster seat or booster cushion for your child while travelling by car.You do not have to use a child restraint device on public transport. The driver is responsible for ensuring that any child who is not occupying a seat properly using an appropriate restraint is secure and cannot move around. If you are travelling with your baby, please ensure that they are in a rear-facing baby seat. If you are carrying more than one infant (for example twins) then it is recommended that each infant should be placed in their own individual baby seat/booster seat/booster cushion. This will ensure they are both secured correctly and can only move within their own safety restraints. If there isn’t enough room for two individual seats next to each other, then one of them should be placed behind an adult (in front of another infant).

Are there any exceptions to the law?

Children under 1 year old are not required to use an approved child restraint. This is because babies of that age can only be seated in an upright position and cannot yet sit unsupported. As a general rule, children should always use an approved child restraint when travelling in cars. This applies whether they’re with their parents or being transported by someone else. However, there are some exceptions: If you’re driving a goods vehicle (i.e., one which has been adapted for carrying goods), your baby doesn't have to use an approved child restraint if he/she is over 1 year old but less than 3 years old. If your baby weighs more than 15kg (33lb) but less than 18kg (40lb), then he/she doesn't have to use an approved child restraint unless your vehicle has been modified for carrying goods or it's fitted with seats specifically designed for babies (in which case he/she must still use one). However, it's important to note that all children under 3 years old who weigh more than 15kg must wear a seat belt even if they're using an approved child restraint.

What happens if I don’t have a baby seat?

If you’re taking your child under 12 months of age with you, it is compulsory that they use an approved baby car seat. If they are unable to sit upright without slouching, or can’t support their own head, or weigh more than 9kg (around 20lbs), then they will also need to travel on a booster cushion for safety reasons. The only exception to these rules is for children aged 10 years and above, who can use an adult belt as long as it fits correctly. All passengers must wear a seatbelt at all times when travelling in any vehicle. So what happens if I don’t have a baby seat? Well, there are some fines associated with not complying with regulations: £500 fine if found guilty of not using an appropriate child restraint system in a private hire vehicle; up to £1,000 fine if found guilty of not using an appropriate child restraint system in other vehicles; and up to £2,500 fine if found guilty of allowing someone else's child to travel unrestrained. It is important that parents make sure they know which law applies to them so they can be sure they are following legal requirements.

You should know that babies must always be carried in an approved and appropriate car seat, unless they are over 12 months old or weigh more than 9kg.
